Terms and Conditions
General Conditions
Unless otherwise stated on the product manual, Anogen products are sold for RUO (research use only), and are not applicable to humans and are not suitable for diagnostic and/or therapeutic purposes.
Anogen reserves the right to discontinue sales of any products or to change product descriptions and/or specifications at any time without prior notification. Furthermore, Anogen reserves the rights to withhold, cancel, or suspend shipment of any products in cases of force majeur including, but not limited to labor troubles, war, civil unrest, accidents, acts of God, and government regulations/restrictions. No Terms and Conditions other than those stated herein, and no modification of these Terms or Conditions, shall be binding on Anogen without Anogen’s written consent.
Shipments
Products are shipped F.O.B Mississauga, Ontario by air delivery service with freight collect unless otherwise specified by the customer. Customers are responsible for their import duties and taxes. Items shipped with Special Export Documentation will be subject to an additional charge.
Payment Terms
Unless otherwise arranged, payment is due upon receipt of goods. A 1.5% monthly late charge on account balances over 30 days past due will be charged from the date of shipment. All checks returned for insufficient funds are subject to a $40.00 USD NSF fee.
Returns
Customers experiencing difficulties with the performance, quality, results or any other aspect of the product, are asked to contact Anogen for technical assistance. Due to the nature and sensitivity of the products to external factors such as temperature, contamination and light, Anogen will not, under any circumstances, accept returned products.
If the product is determined by Anogen to have failed, or if the cause of the failure cannot be ruled out as a potential, probable or likely product failure, customers will be provided with the option to receive a replacement product at no charge, a credit, or a refund.
If the product failure is determined to be directly user-related or by conditions resulting from improper use of the product including, but not limited to, contamination, storage conditions, assay procedures, equipment suitability, etc., or if the customer has ordered the product in error and requires a replacement product, no credit will be provided and Anogen will require pre-payment for the replacement product and shipping before it can be shipped.

Shipping
Anogen employs Federal Express (FedEx) courier services for delivery of products. Customers may utilize their unique FedEx account information at any time. Anogen will assume all responsibility associated with the delivery of the product via FedEx including lost, damaged, or otherwise compromised product due to inadequate shipping. The customer may, at their discretion, elect an alternate courier in place of FedEx. If an alternate courier is to be employed, Anogen provides no warranty or guarantee to the fitness or timely delivery of a product that is shipped by any other courier service other than Federal Express. By selecting an alternate courier, the customer assumes full responsibility to delayed, lost, damaged or otherwise compromised product. No return of products shipped via non-approved couriers will be authorized.
Warranty & Limitation of Liability
All of Anogen’s products are warranted to perform as described in their associated literature. It is the customer's responsibility to maintain updated copies of the product literature available on the Internet at www.anogen.net or by contacting an Anogen Customer Service Representative.
This warranty is exclusive and the Supplier makes no other warranty, expressed or implied, including any implied warranty of merchantability or fitness for any particular purpose. Purchaser assumes all risks associated with the modification of products, and is encouraged to investigate the standing regional and governmental regulations and policies as well as potential patent infringements. The Supplier shall not be liable for any incidental, consequential or contingent damages.
